Reproducible Example

import pandas as pd
from pandas._testing import assert_index_equal

assert_index_equal(
    pd.Index([1, 3], name="a"),
    pd.Index([3, 1], name="b"),
    check_order=False,
    check_names=True
)

Issue Description

This should raise, but does not.
